Applicability

The general conditions are applicable on all quotations, offers and transactions between ELEGANT MAKEUP & HAIR and its clients. ELEGANT MAKEUP & HAIR does not accept general conditions of other parties unless this has been agreed upon in writing. These conditions can only be abandoned if both parties have agreed to do so in writing. Should a situation arise between the two parties which has not been covered by the general conditions, then this situation should be evaluated according to the essence of these general conditions. The client accepts the applicability of these general conditions when making the reservation and/or ordering a service or product of ELEGANT MAKEUP & HAIR.

The client will ensure that all data relevant for an efficient execution will be made available in time to ELEGANT MAKEUP & HAIR.

Realisation of a booking

A booking is created when the client accepts an offer by ELEGANT MAKEUP & HAIR whether verbally, over the telephone, in writing or digitally. The client acknowledges to have taken note of the general conditions of ELEGANT MAKEUP & HAIR.

The first quotation issued is mutually without obligation. No rights can be derived from printing errors, typesetting errors, and handwritten errors, in addition to garbled quotations. A quotation has a validity of 14 days unless otherwise indicated. The bridal styling agreement is legally valid after signing by both parties. Offers and quotations are not automatically valid for future assignments.

Travel expenses

Any travel expenses made by ELEGANT MAKEUP & HAIR are on behalf of the client and based on a kilometer allowance of EUR 0.30 per kilometer. Parking expenses will be passed on to the client.

Payment

Payment of the invoice amount should take place within 14 days after the invoice date. A payment can be made in cash or by electronic bank transfer. All prices include VAT. One week after the trial session the client is required to make a deposit of 25% of the total amount. Seven days prior to the wedding day, the remaining amount should have been paid unless agreed upon otherwise. Should the term of payment be exceeded, the client is obliged by operation of law to additionally pay the statutory interest of the outstanding amount.

All judicial and extrajudicial costs that ELEGANT MAKEUP & HAIR has to incur to collect the amount owed by the client, will be borne by the client.

Circumstances beyond control

In case of a circumstances beyond control, such as illness, ELEGANT MAKEUP & HAIR is able to cancel the assignment, either in part or in its entirety. Billing will be adjusted proportionately. For bridal styling assignments, ELEGANT MAKEUP & HAIR will make an effort to find a suitable colleague to take over the assignment. However, ELEGANT MAKEUP & HAIR is unable to guarantee availability of a replacement. In case of circumstances beyond control, the client cannot sue ELEGANT MAKEUP & HAIR for damages.

Cancellation, termination and suspension of the agreement

Should the client cancel the agreement in part of in its entirety, the costs incurred by ELEGANT MAKEUP & HAIR, including compensation to third parties, will be compensated by the client as a result of the cancellation. A booked assignment can be cancelled free of charge by the client up to 30 days before the assignment actually takes place. Payments already made will be refunded with the exception of payment for the bridal styling. If the booked assignment is cancelled, the client owes the following cancellation costs:

- If cancelled from the 30th day to the 14th day prior to the day of the assignment: 50%. With the exception of bridal styling;

- If cancelled from the 13th day prior to the day of the assignment: 100%. With the exception of bridal styling.

Cancellation of bridal styling: 14 days after the invoice date a deposit of 25% is required to which no refund applies. Thereafter the following cancellation costs apply;

​

- If cancelled from 14 days after the trial session, see agreement, until 30 days prior to the wedding day: 50% cancellation costs;

- If cancelled 29 days before 29 days prior to the wedding day.

Liability and damage

ELEGANT MAKEUP & HAIR will execute the agreement to the best of its knowledge and ability, and in accordance with the requirements of good workmanship. ELEGANT MAKEUP & HAIR is not responsible for damage, of whatever nature, caused by ELEGANT MAKEUP & HAIR assuming incorrect and/or incomplete information provided by the client. Complaints should be reported in writing and sufficiently motivated to ELEGANT MAKEUP & HAIR within 5 working days after the assignment has been executed.

ELEGANT MAKEUP & HAIR excludes any liability and rejects possible damage claims, both direct and indirect, which have resulted from circumstances not attributable to intent or gross negligence on the part of ELEGANT MAKEUP & HAIR, and which under Dutch law or the standards applicable in society at large cannot be attributed to ELEGANT MAKEUP & HAIR. Compensation is only eligible for damage for which ELEGANT MAKEUP & HAIR is insured and which will be compensated by the insurance company. Excluded from compensation are consequential damage, trading loss and immaterial damage.

 

Personal data

Client data will not be shared with third parties and will only be used for and by ELEGANT MAKEUP & HAIR. Imagery made by ELEGANT MAKEUP & HAIR or supplied by third parties will only be used on social media channels and on the website after approval of the client, whether by oral consent or assignment form.

Amendments and location of the general conditions The general conditions can be found on the website of ELEGANT MAKEUP & HAIR, being www.elegantmakeuphair.nl. The reference to the general conditions is indicated om the assignment form. The latest version, or the version which applied at the time of the conclusion of the agreement, is always applicable

Final provision

Dutch law applies to these general conditions and to each agreement between the client and ELEGANT MAKEUP & HAIR. All disputes that may arise as a result of an agreement between ELEGANT MAKEUP & HAIR and the client or any agreement that may be a result therefrom, will only be tried by a Dutch judge. Parties will only invoke their rights after they have made every effort to settle a dispute by mutual agreement
